These Terms & Conditions govern your use of Unimaginative.org and purchases made from Unimaginative.
By accessing the Site, placing an order, or otherwise using our services, you agree to these Terms to the extent permitted by applicable law.
About Unimaginative
The terms “Unimaginative,” “we,” “us,” and “our” refer to the operator of Unimaginative.org.
Our online store is hosted using Shopify and may rely on other service providers for payment processing, production, fulfillment, shipping, analytics, communications, and related services.
Products and Artwork
We make reasonable efforts to describe and display products accurately.
Colors, dimensions, textures, finishes, placement, and other visual details may appear differently depending on screens, photography, production methods, materials, printing processes, or normal manufacturing variation.
For handmade, artist-made, limited-edition, or individually produced items, reasonable variation is part of the nature of the product and does not necessarily constitute a defect.
Product descriptions, photographs, mockups, specifications, measurements, and other content are provided for informational purposes and may be corrected or updated when appropriate.
Availability
Products may be limited in quantity and may become unavailable without notice.
Placement of an item in a shopping cart does not reserve inventory.
We may limit quantities, discontinue products, restrict sales, or decline or cancel orders when reasonably necessary for inventory, fraud prevention, legal compliance, production limitations, suspected resale activity, pricing errors, or other legitimate business reasons.
Orders
Submitting an order constitutes an offer to purchase.
An automated order confirmation acknowledges that we received the order but does not necessarily constitute final acceptance of the transaction.
We reserve the right to accept, decline, hold, or cancel an order before fulfillment when reasonably necessary.
If we cancel an order after collecting payment, we will refund the applicable amount as required by law.
Prices and Errors
Prices and product information may change without notice.
Although we try to maintain accurate information, typographical errors, incorrect prices, inaccurate product information, technical errors, or other mistakes may occasionally occur.
We reserve the right to correct errors and, where legally permitted, cancel an affected order rather than fulfill an order based on an obvious or material error. If payment has already been collected for an order we cancel, the applicable amount will be refunded.
Payment
You agree to provide current, complete, and accurate billing and payment information.
Payment processing may be performed by third-party payment providers. We do not necessarily receive or retain complete payment-card information.
Orders may be delayed, declined, or cancelled when payment cannot be authorized or when a transaction reasonably appears fraudulent or unauthorized.
Shipping, Returns, Repairs, and Refunds
Shipping is governed by our then-current Shipping Policy.
Returns, repairs, exchanges, and refunds are governed by our then-current Return Policy, subject to rights that cannot legally be waived.
Policies applicable to a transaction will be interpreted together with these Terms.
Intellectual Property
Unless otherwise stated, all original artwork, illustrations, designs, photographs, graphics, logos, text, product designs, branding, and other creative material appearing on the Site are owned by or licensed to Unimaginative and are protected by applicable intellectual-property laws.
Purchasing a physical product or print does not transfer copyright or other intellectual-property rights in the underlying artwork.
You may not reproduce, copy, modify, distribute, manufacture from, commercially exploit, scrape, republish, train an artificial-intelligence system on, or create derivative commercial products from our protected material without permission, except where such activity is expressly permitted by law.
Permitted Use of the Site
You may use the Site for lawful personal and commercial shopping purposes.
You may not use the Site to interfere with its operation, attempt unauthorized access, introduce malicious code, scrape protected content at scale, impersonate another person, commit fraud, violate intellectual-property rights, or engage in unlawful activity.
We may restrict access where reasonably necessary to protect the Site, our customers, our business, or third parties.
Reviews, Messages, and Submitted Content
If you voluntarily submit reviews, photographs, comments, feedback, or similar material to us, you represent that you have the right to provide it and that it does not unlawfully infringe another person’s rights.
Unless we separately agree otherwise, feedback or suggestions regarding the business may be used by us without an obligation to compensate you.
We will not claim ownership of your pre-existing intellectual property merely because you communicate with us.
Third-Party Services and Links
The Site may rely on or link to services operated by third parties.
We do not control third-party websites, carriers, payment processors, social-media platforms, applications, or other independent services and are not responsible for their separate acts, omissions, policies, availability, or content.
Use of third-party services may be governed by their own terms and policies.
Disclaimer of Warranties
To the fullest extent permitted by law, the Site and its content are provided on an “as available” basis.
We do not warrant that the Site will always operate without interruption or error.
Nothing in these Terms excludes any product warranty, consumer guarantee, statutory right, or other protection that applicable law does not permit us to exclude.
Limitation of Liability
To the fullest extent permitted by law, Unimaginative will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site or a transaction with us when such damages may lawfully be excluded.
Nothing in these Terms limits liability that applicable law does not permit us to limit, including any nonwaivable consumer rights.
Indemnification
To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful misuse of the Site, violation of these Terms, or infringement of another person’s rights.
This provision does not require you to indemnify Unimaginative for conduct for which applicable law makes Unimaginative responsible.
Events Outside Our Control
We are not responsible for delay or failure to perform caused by events reasonably outside our control, including severe weather, natural disasters, fire, transportation interruptions, carrier disruptions, labor disputes, government action, war, civil unrest, widespread telecommunications or internet failures, supplier failures, or similar circumstances.
This provision does not eliminate rights that cannot legally be waived.
Changes to These Terms
We may revise these Terms from time to time.
Changes become effective when posted unless a different effective date is stated.
A purchase will generally remain subject to the material terms in effect when the transaction was made, except where a later change is required by law or expressly agreed to.
Severability and Waiver
If part of these Terms is found unenforceable, the remaining provisions will continue to apply to the fullest extent legally permitted.
A failure to enforce a provision on one occasion does not necessarily waive the right to enforce it later.
Governing Law
These Terms are governed by the laws of California, United States, without regard to conflict-of-law principles, except to the extent applicable consumer law requires otherwise.
Nothing in this section deprives a consumer of mandatory protections provided by the law of the consumer’s jurisdiction.
